Product Description
Restraining Notice to Debtor legal form used to notify a debtor of a money judgment and forbids the person receiving the form (the debtor) from selling or transferring stated assets listed in the notice to satisfy the judgment. The New York State statute states:
A judgment debtor served with a restraining notice is forbidden to make or suffer any sale, assignment, transfer or interference with any property in which he has an interest, except upon direction of the sheriff or pursuant to an order of the court, until the judgment is satisfied or vacated… Such a person is forbidden to make or suffer any sale, assignment or transfer of, or any interference with, any such property, or pay over or otherwise dispose of any such debt, to any person other than the sheriff, except upon direction of the sheriff or pursuant to an order of the court, until the expiration of one year after the notice is served
This form is frequently used in conjunction with the New York - Restraining Notice to Garnishee legal form, which is sent to a “garnishee” which may be a bank, institution or other individual who is in possession of property owned by the judgment debtor.
