I was in an abusive relationship for 3 plus years. I had shared custody with the grandfather because the father relinquished his rights. I was not allowed to go to court ordered therapy. My ex held me hostage essentially. I left him september 1st,2017. The paternal grandparents have had my child for a year now. They filed emergency custody. My child was never exposed to my ex so he never encountered abuse. They are withholding information from me, and said they are allowing me to see my child at the bus stop, at soccer games, and cub scouts. That I'm the negative one and I am the dtrimant to my child. Yet those are all lies. I am trying to push my way in, but the grandmother wants to play mommy to my child and is actually passive aggresive and is not supporting our relationship. What rights do I have? Also I have supervised visitation which they don't even practice. I am not allowed to be with my 5 1/2 year old alone.Yet I am not a danger to my child. Could I contest that?Also grandmother is controlling, and grandfather is an enabler. My child is turning into someone very entitled, and more of an adult then acting his actual age.I need help legally on trying to get my child back.

Please elaborate. One cannot simply "relinquish" ones parental rights. A court order is required, and such orders are extremely rare. It would also be completely unusual for a court to order joint custody between a mother and a grandparent.

Like every other person, you have dozens of rights, and it would serve no useful purpose to try and create a list. The better question is whether a court has divested you of or limited any of your parental rights, and we obviously don't know that.

I have supervised visitation which they don't even practice.

So...take the matter to court and seek to have the grandparents held in contempt and request a modification of the existing custody/visitation order.

Father lied about giving me his rights, and gave it to his parents. Parents claimed he was unfit.Courts granted that.Father is trans, and apparently "unfit"

*due to the recent court order dated a year ago paternal gp filed for emergency custody. I have no rights listed, yet father has rights to all documents. My mother is included in the agreement. The only thing they gave were supervised visitation in GP's residence. Which again is not being practiced. Could I contest that I do not need supervision around my child?

Consult 2 or 3 local attorneys who specialize in domestic relations or family law matters.

Usually there's no charge for the initial consultation.

If money is an issue, be sure to ask before confirming.

The consult is a great way to see if you could work with a lawyer, how she interacts with you, and how much representation costs.

The biggest plus you'll get 30 minutes or so to ask questions about your issues.
 
let me clarify these are two different ex's. My 5 1/2 year old is the one in the paternal gps custody. His father is the transgender person who gave his rights up. My recent ex, father of 18 month old was the abusive relationship of 3 years. Whom I'm no longer with. Just to clarify for everyone. I have custody of my 18 month old.

You need a licensed attorney in your county to assist you in whatever domestic legal matters you wish to pursue.

Are you sure your ex voluntarily relinquished his rights? Courts rarely allow this.

First you say you have shared custody and then you say you have supervised visitation...you need to get a lawyer and take these people to court because if they aren't letting you have your visitation they are in contempt.

You need a lawyer.
